I think history is clear that it was the latter--so that it is DISHONEST to attempt to read Thomistic natural law into what the Founders intended. Instead, let us look to the COMMON LAW, which DID enshrine Natural Law, and which WAS a legitimate ancestor to the American Founding, as the source of our historical arguments. Of course, where a piece of Common Law FAILED to live up to natural law, we critique it, and pass positive laws that bring our own tradition closer to the goal. Sent at: 2008 09 07
