A simple Declaration of War against Al Qaeda and the Taliban would have led their captured personnel to be declared simple prisoners of war and if we announced that would treat them as all prisoners of war, as we had done in the past even without such a declaration in Vietnam or Korea or even the first Gulf War, we would not be in the legal mess we are in. We could still even use Gitmo as a prison camp and deal with war crminals after the conflict was concluded. But this is according to the powers that be "anachoristic". Sent at: 2008 12 02
