Congress can remove ANY item from consideration by the federal courts, and the Bush administration has, in fact, proposed legislation concerning the Pledge of Allegiance and torture that would have taken that constitutional route. They refused, however, to endorse a Republican-sponsored bill that would have done the same for abortion.
